Specifying, among other things, the principles of concluding sales contracts through the store, containing the most important information about the Seller, the store, and the Consumer's rights.

§ 1 DEFINITIONS


Working days - days from Monday to Friday, excluding public holidays.
Account - a free store feature (service provided electronically) governed by separate regulations, through which the Buyer can create their individual account in the store.
Consumer - a consumer within the meaning of the provisions of the Civil Code.
Buyer - any entity purchasing from the store.
Rules and regulations - these rules and regulations.
Store - mimii.pl online store operated by the Seller at https://www.mimiikds.fr.

§ 3 TECHNICAL REQUIREMENTS


The following are necessary for the proper functioning of the store:

A device with Internet access

Web browser supporting JavaScript and cookies.

To place an order in the store, in addition to the requirements specified in paragraph 1, an active email account is required.

§ 4 PURCHASES IN THE STORE


The prices of the goods indicated in the store are the total prices of the goods, including VAT.

The seller reminds that the total price of an order consists of the price of the goods indicated in the store and, if applicable, the delivery charges for the goods.

The goods selected for purchase must be added to the shopping cart in the store.

The buyer then chooses the delivery method for the goods and the payment method for the order from those available in the store and provides the necessary data to execute the placed order.

The order is placed when the buyer confirms its content and accepts the general conditions.

Placing an order is equivalent to concluding a sales contract between the Buyer and the Seller.

The seller provides the consumer with confirmation of the conclusion of the sales contract on a durable medium no later than at the delivery of the goods.

The buyer can register in the store, that is, create an account, or make purchases without registering by providing their data with each possible order.

§ 5 PAYMENTS
An order placed can be paid, at the buyer's choice:

If the buyer chooses to pay in advance, the order must be paid within 5 working days following the order.

The Seller informs that in the case of certain payment methods, due to their specificity, payment for the order by this method is only possible immediately after placing the order.

By purchasing in the store, the buyer agrees to the use of electronic invoices by the seller. The buyer has the right to withdraw their consent.

§ 6 ORDER EXECUTION


The seller is obliged to deliver goods without defects.

The order processing time is indicated in the store.

In the event that the Buyer has chosen to pay for the order in advance, the Seller will proceed with the order after payment.

If the Buyer has purchased goods with different delivery times within the same order, it will be executed within the timeframe applicable to the goods with the longest delivery time.

The country where the delivery takes place is France.
Goods purchased in the store are delivered by the GLS courier service.


    § 7 RIGHT OF WITHDRAWAL


    The consumer has the right to withdraw from the contract concluded with the seller through the store, subject to Article 8 of the general conditions, within 14 days without giving any reason.

    The withdrawal period for the contract expires 14 days after the day:

    The day the consumer took possession of the goods or the day a third party other than the carrier and indicated by the consumer took possession of the goods.

    The date on which the consumer took possession of the last item or the date on which a third party, other than the carrier and indicated by the consumer, took possession of the last item in the case of a contract involving the transfer of ownership of several goods delivered separately.

    For the Consumer to exercise their right of withdrawal, they must inform the Seller, using the data provided in § 2 of the General Conditions, of their decision to withdraw from the contract by an unequivocal statement (for example, a letter sent by post or information transmitted by email).

    The consumer may use the withdrawal form template at the end of the general terms and conditions, but this is not mandatory.

    To meet the withdrawal deadline, it is sufficient for the consumer to send information concerning the exercise of their right of withdrawal before the withdrawal period expires.

    THE EFFECTS OF WITHDRAWAL

    In the event of withdrawal from the concluded contract, the seller will refund the consumer all payments received from them, including delivery costs of the goods (except for additional costs resulting from the delivery method chosen by the consumer other than the least expensive standard delivery offered by the seller), immediately and in any case no later than 14 days from the day the seller was informed of the consumer's decision to exercise their right of withdrawal.

    The seller refunds the payment using the same means of payment used by the consumer in the initial transaction, unless the consumer agrees to a different solution; in all cases, the consumer incurs no costs related to the refund.

    The seller may withhold the refund until it has received the goods or until it has received proof of return, whichever occurs first.

    The seller requests that the goods be returned to the address: ul. 30 Stycznia 38b, 83-110 Tczew, immediately and in any case no later than 14 days from the day the consumer informed the seller of the withdrawal from the sales contract. The deadline is met if the consumer returns the goods before the expiration of the 14-day period.

    The direct costs of returning the goods are borne by the consumer.

    The consumer is only responsible for any diminished value of the goods resulting from use other than what was necessary to establish the nature, characteristics, and functioning of the goods.

    If the goods, due to their nature, cannot be returned by the usual postal means, the consumer must also bear the direct costs of returning the goods. The estimated amount of these costs will be communicated by the seller in the product description in the store or at the time of placing the order.

    In the event that a refund is requested for a transaction made by a customer with a payment card, the seller will refund the amount to the bank account linked to the buyer's payment card.

    § 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL


    The consumer has no right of withdrawal for a distance contract related to a contract:

    In which the subject of the performance is a non-reproducible item, produced according to the consumer's specifications or serving to meet their individualized needs.

    In which the subject of the performance is a perishable item or one with a short lifespan.

    In which the subject of the performance is an item supplied in a sealed package that cannot be returned after opening for health or hygiene reasons, if the package has been opened after delivery.

    In which the subject of the performance consists of things that, by their nature, are inseparable from other things after delivery.

    In which the subject of the representation is a sound or visual recording or a computer program delivered in a sealed package if the package has been opened after delivery.

    On the supply of newspapers, periodicals, or magazines, except for a subscription contract.

    When the price or remuneration depends on fluctuations in the financial market beyond the control of the trader and which may occur before the end of the withdrawal period.

    For the provision of digital content that is not recorded on a tangible medium if the performance has begun with the express consent of the consumer before the end of the withdrawal period and after the professional has informed the consumer of the loss of the right of withdrawal.

    The right of withdrawal from a distance contract is not granted to an entity other than the consumer.

    § 9 COMPLAINTS


    In case of defective goods, the buyer has the right to complain about defective goods based on the warranty regulated in the Civil Code, provided that the warranty has been granted.

    By using the warranty, the Buyer may, according to the principles and within the deadlines provided by the Civil Code:

    Make a declaration to reduce the price

    In case of a material defect, make a declaration of contract termination.

    Request the replacement of the item with a defect-free item

    Demand the removal of the defect

    The Seller requests that warranty claims be submitted to the postal or email address indicated in §2 of the General Terms and Conditions.

    If it turns out that to examine the complaint it is necessary to deliver the goods subject to the complaint to the seller, the buyer is obliged to deliver the goods, in the case of a consumer, at the seller's expense, to the address 30 Stycznia 38b, 83-110 Tczew.

    If an additional warranty is granted for the goods, information about it and its conditions are available in the product description in the store.

    Complaints regarding the operation of the store must be sent to the email address indicated in §2 of the general terms and conditions.

    Complaints are examined by the seller within 14 days.

    EXTRAJUDICIAL COMPLAINT AND CLAIM PROCEDURE

    If the complaint procedure does not result in the outcome expected by the consumer, the consumer may, among other things, use the following means

    Mediation conducted by the locally competent provincial trade inspection, to which a mediation request must be submitted. Procedures are generally free of charge. The list of inspections can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595.

    Assistance from a permanent local consumer arbitration court operating at the provincial trade inspection, to which a request for case review before the arbitration court should be addressed.     Free assistance from the consumer mediator of the municipality or district.

    § 10 PERSONAL DATA


    The administrator of the personal data provided by the buyer when using the store is the seller.

    The Buyer's personal data is processed based on consent and for the purpose of its execution, in accordance with the principles set out in the General Data Protection Regulation (GDPR) of the European Parliament and Council (EU). Detailed information on data processing by the seller is included in the privacy policy displayed in the store.

    § 11 DISCLAIMER CLAUSES


    Providing illegal content by the buyer is prohibited.

    Each time an order is placed in the store, it constitutes a separate sales contract and requires separate acceptance of the general terms and conditions. The contract is concluded for the duration and purpose of fulfilling the order.

    Contracts concluded based on this regulation are concluded in the Polish language.

    In the event of a dispute with a Buyer who is not a Consumer, the competent court is that of the Seller's registered office.

    None of the provisions of these general terms and conditions exclude or limit in any way the rights of the Consumer resulting from the provisions of the law.
